ALGEMENE VOORWAARDEN - TERMS & CONDITIONS

 

1. TOEPASSELIJKHEID - APPLICABILITY

  • Deze ‘Algemene Voorwaarden’ zijn van toepassing op alle aangeboden producten door Sofie Nuyttens Jewellery.
  • These ‘Terms and conditions’ apply to all offered products by Sofie Nuyttens Jewellery.

 

2. ALGEMENE VOORWAARDEN - GENERAL TERMS AND CONDITIONS 

De verkoper is geregistreerd onder BTW-nummer BE0701695624 en kan gecontacteerd worden via sofie_nuyttens_jewellery@hotmail.com.

Elke bestelling wordt beschouwd als een aanvaarding van de algemene voorwaarden door de consument. Deze algemene voorwaarden maken integraal deel uit van de overeenkomst zoals hieronder beschreven.

Iedereen die een bestelling plaatst, bevestigt door het plaatsen van de bestelling dat hij een natuurlijk persoon is en geen handelaar, of minstens niet bestelt als handelaar. Een handelaar die een bestelling wil plaatsen voor professionele doeleinden, dient contact op te nemen met Sofie Nuyttens Jewellery via e-mail: sofie_nuyttens_jewellery@hotmail.com.

Een klant die een bestelling plaatst, verklaart de algemene voorwaarden van de verkoper te kennen en te aanvaarden. De algemene voorwaarden zijn steeds beschikbaar en kunnen geraadpleegd worden via de website.

  • The website www.sofienuyttensjewellery.be is property of Sofie Nuyttens. The vendor is registered under VAT number BE0701695624 and can be contacted via sofie_nuyttens_jewellery@hotmail.com

Every order will be considered as an acceptance of the general terms and conditions by the consumer. These general terms and conditions are an integral part of the agreement as described below.

Anyone who places an order confirms by placing the order that he is a natural person and not a merchant or at least not ordering as a merchant. A trader who wants to place an order for professional purposes, should apply to Sofie Nuyttens Jewellery by e-mail; sofie_nuyttens_jewellery@hotmail.com

A customer, who orders, declares to know and accept the general terms and conditions of the seller. The general terms and conditions are always available and can be consulted via the website.

 

3. PRODUCT

  • Elk juweel is handgemaakt en dus uniek. Het kan daarom lichtjes afwijken van wat je ziet op de websitefoto’s. Indien je extra foto’s of een filmpje wenst, laat het me weten.
  • Please note that each jewel is handmade and therefore unique. It may therefore differ slightly from what you see on the website picture. If you need extra pictures or film, please let me know.

 

4. PRIJZEN - PRICING

  • De prijzen van de producten en diensten zijn aangeduid in euro, inclusief 21% BTW, exclusief leveringskosten, transportkosten en/of andere belastingen of heffingen. De klant betaalt de leveringskosten.

Betaling kan enkel op de wijze zoals aangegeven tijdens het plaatsen van de bestelling. Bestellingen worden pas verwerkt vanaf het moment dat Sofie Nuyttens Jewellery de betaling heeft ontvangen. Alle producten blijven eigendom van Sofie Nuyttens Jewellery tot het volledige betaling is ontvangen.

De levering van het juweel gebeurt pas nadat Sofie Nuyttens Jewellery de volledige betaling heeft ontvangen. Indien er niet betaald wordt binnen 7 dagen na bestelling, zal Sofie Nuyttens Jewellery de consument schriftelijk melden dat de overeenkomst zonder gerechtelijke tussenkomst geannuleerd wordt.

Alle aanbiedingen zijn vrijblijvend, kunnen aangepast of ingetrokken worden en zijn geldig zolang de voorraad strekt. Sofie Nuyttens Jewellery behoudt zich het recht voor prijzen te wijzigen. De prijs die geldt voor het aangekochte product is steeds de prijs op de datum van bestelling.

  • The prices of the products and services are indicated in euro, 21% VAT inclusive and exclude delivery costs, transportation expenses and/or any other taxes or other duties. The customer pays any delivery costs. Payment can be made by the method as indicated during placing the order. Orders are only paid effectively from the moment payment has been received by Sofie Nuyttens Jewellery. All products remain property of Sofie Nuyttens Jewellery until full payment is received.

 The delivery of the jewel will only take place if Sofie Nuyttens Jewellery has received full payment. In the event of default of payment within 7 days after ordering, Sofie Nuyttens Jewellery will give notice to the consumer that the agreement will be canceled without judicial authorization.

All offers are non-binding, can be adjusted or withdrawn and are valid as long as the stock isn’t exhausted. 

Sofie Nuyttens Jewellery reserves the right to alter prices. The price applicable on the purchased product is the price at the date on which the order is placed.

 

5. AANVAARDING VAN DE BESTELLING - ACCEPTANCE OF THE ORDER

  • Een bestelling is pas bindend voor Sofie Nuyttens Jewellery na bevestiging via e-mail of bericht. Sofie Nuyttens Jewellery heeft het recht bestellingen te weigeren.

Alle productinformatie en prijzen zijn steeds onderhevig aan mogelijke wijzigingen of correcties. De prijs die geldt, is steeds de prijs op de datum van bestelling.

  • An order is not binding for Sofie Nuyttens Jewellery until confirmed via e-mail by Sofie Nuyttens Jewellery. Sofie Nuyttens Jewellery has the right to refuse orders.

All product information and pricing are at all times subject to possible fluctuation or correction. The price applicable on the purchased product is the price at the date on which the order is placed.

 

6. LEVERING - DELIVERY

  • Sofie Nuyttens Jewellery streeft ernaar om de bestelde juwelen binnen de aangegeven levertijd te bezorgen. Het is mogelijk dat, door bepaalde omstandigheden, de levering vertraging oploopt. In dat geval wordt de klant op de hoogte gebracht en zal de levering plaatsvinden binnen een redelijke termijn.

De leveringstermijn start na ontvangst van de betaling. De maximale leveringstermijn bedraagt 60 dagen na ontvangst van betaling.

De verkoper is niet aansprakelijk voor vertragingen door overmacht.
De koper is aansprakelijk voor fouten bij levering ten gevolge van een fout adres en bijkomende kosten kunnen aangerekend worden.

Bij niet-levering worden betaalde bedragen teruggestort, zonder intresten of bijkomende vergoedingen.

De koper betaalt de verzendkosten verbonden aan de bestelling. De verzendkosten variëren afhankelijk van het totale bestelbedrag en het land van levering.

  • Sofie Nuyttens Jewellery tries to deliver the ordered jewellery within the indicated delivery time. It is possible that Sofie Nuyttens Jewellery, due to certain circumstances, fails to deliver the ordered product in time. In that case, Sofie Nuyttens Jewellery will give notice to the customer and the delivery will take place within a reasonable time.

The delivery period starts after receipt of payment. The delivery period is a maximum of 60 days after receipt of payment for delivery.

The seller is not liable for delays due to force majeure.

The buyer is liable for incorrect delivery due to a wrong delivery address and additional costs may apply.

In the event of non-delivery, any amounts paid by the buyer-consumer are reimbursed without interests or any other compensation.

The buyer pays any delivery costs associated with the order. The delivery costs of our transport service vary and depend on the total amount of the order and the country of delivery.

 

7. KLACHTEN - COMPLAINTS

  • Om ontvankelijk te zijn, moeten klachten onmiddellijk gemeld worden aan Sofie Nuyttens Jewellery via e mail: sofie_nuyttens_jewellery@hotmail.com.

Indien de levering niet overeenstemt met de bestelling, moet dit binnen 7 dagen na levering gemeld worden.

Bij verborgen gebreken die zich voordoen binnen 3 maanden na levering, moet de klacht gemeld worden binnen 7 dagen na de ontdekking. In deze schriftelijke communicatie moet de schade omschreven worden en bewijs (bv. foto) worden toegevoegd.

  • In order to be admissible and under penalty of preclusion of rights, complaints need to be addressed immediately to Sofie Nuyttens Jewellery by e-mail; sofie_nuyttens_jewellery@hotmail.com

If the delivery is out of line with the buyer-consumer’s order, the complaint needs to be addressed to Sofie Nuyttens Jewellery within 7 days after the delivery.

In the event of hidden defects that occur within a period of 3 months after delivery, the complaint needs to be addressed to Sofie Nuyttens Jewellery within a period of 7 days following the discovery of the defect. In this written communication, the buyer-consumer needs to describe the damage and provide proof of damage via photo.

 

8. VERZENDING EN RETOURS

9. GARANTIE - WARRANTY

  • De garantie van Sofie Nuyttens Jewellery beperkt zich tot de wettelijke garantie voor verborgen gebreken en de consumentenbescherming zoals bepaald in het Belgisch Burgerlijk Wetboek.

Indien een goed binnen 6 maanden na levering defect raakt, wordt verondersteld dat het defect reeds bestond bij levering, tenzij de verkoper het tegendeel bewijst.
Na 6 maanden moet de consument zelf aantonen dat het goed niet conform was bij levering.

Een goed met een aanvaard defect zal kosteloos vervangen of hersteld worden. Indien de herstellingskosten onevenredig hoog zijn, behoudt de verkoper zich het recht voor om het item te vervangen door een soortgelijk stuk.

  • The warranty of Sofie Nuyttens Jewellery is restricted to the warranty for hidden defects and the Buyer-consumer Guarantees Act, both listed in the Belgian Civil Code.

Sofie Nuyttens Jewellery is not liable for general or specific indirect damage, of any kind, possibly inflicted by the buyer-consumer.

If the good becomes defective within the first six months after delivery, it is assumed that the defect has existed since the delivery. The seller must prove otherwise if he does not agree.

If the defect of the good is established more than six months after delivery, you as a consumer must prove that the good was non-conforming at the time of delivery.

An item with an accepted defect will be replaced or repaired free of charge. If the costs of repair are disproportionate, the seller reserves the right to replace or exchange the item with a similar item.

 

10. HERROEPINGSRECHT - RIGHT OF RENUNCIATION

  • De consument heeft het recht om Sofie Nuyttens Jewellery binnen 14 kalenderdagen na levering te informeren dat hij/zij afziet van de aankoop, zonder boete en zonder opgave van redenen.

Let op: op maat gemaakte juwelen kunnen niet geruild of geannuleerd worden. Door een voorschot of volledige betaling te doen, stem je in met de bestelling.

Retouren dienen vooraf gemeld te worden via e-mail. Niet-aangekondigde retouren worden niet aanvaard.

De klant dient het product binnen 14 kalenderdagen terug te sturen naar het adres dat per e-mail wordt meegedeeld.
De retourkosten zijn steeds voor de klant en op eigen risico.

Retour wordt enkel aanvaard indien het product ongedragen, onbeschadigd, ongebruikt en in de originele verpakking zit.
Wij adviseren om een verzekerde verzenddienst te gebruiken.

Na verwerking van de retour wordt het bedrag teruggestort via bankoverschrijving.

  • The consumer has the right to inform Sofie Nuyttens Jewellery that he renounces the purchase, without payment of a fine and without giving any reason, within 14 calendar days from the day following the delivery of the good.

However, custom-made jewellery cannot be exchanged. There is therefore no right of renunciation for customization. By paying an advance or in full you agree to the order for the customization. Afterwards, these orders for customization can no longer be cancelled.

The customer must give notice to Sofie Nuyttens Jewellery of the decision to invoke his or her right of renunciation of the agreement by e-mail sofie_nuyttens_jewellery@hotmail.com. Every return needs to be reported to Sofie Nuyttens Jewellery first. Unannounced returns will not be accepted.

The customer must return the item by post within 14 calendar days to the address provided in the e-mail by Sofie Nuyttens Jewellery, in response to the customers e-mail with the complaint.

The customer is responsible for the costs of return.

In any case, return is only accepted if the item is unsoiled, undamaged and unworn and in the original packaging.

The abovementioned returning of the products is at the buyer-consumer’s expense and at his own risk.
To ensure the safe delivery of the package, we advise using an insured carrier service.

After processing the return, the customer will be refunded by Sofie Nuyttens Jewellery by bank transfer.

 

11. OVERMACHT - FORCE MAJEURE EVENT

  • Situaties buiten de controle van Sofie Nuyttens Jewellery die redelijkerwijs niet voorzienbaar zijn, worden beschouwd als overmacht. Dit ontslaat Sofie Nuyttens Jewellery van haar verplichtingen.

Dit kan o.a. zijn: technische storingen, bevoorradingsproblemen, stakingen, gebrek aan grondstoffen, stroomuitval, storingen van de website, enz.

De klant wordt in dit geval op de hoogte gebracht dat de bestelling wordt opgeschort.

Events outside Sofie Nuyttens Jewellery control, which are not reasonably foreseeable, shall be considered as Force Majeure. Force Majeure has the effect that Sofie Nuyttens Jewellery is released from her obligations to fulfil the order.

  • Sofie Nuyttens Jewellery cannot be held responsible for possible delays in the execution or for non-execution caused by any circumstance beyond Sofie Nuyttens Jewellery’s control. These circumstances include e.g. occasional malfunction of the site, difficulties with the supply, production shutdown or lack of raw materials, interruption or permanent suspension of production, strikes, any other form of business disturbances or trade disputes, power failure witch cause non or late delivery by Sofie Nuyttens Jewellery.

In this case Sofie Nuyttens Jewellery will inform the customer that the order will be suspended.

 

12. PERSOONLIJKE GEGEVENS - PERSONAL INFORMATION

  • Door een bestelling te plaatsen, geeft de koper toestemming tot de verwerking van zijn/haar persoonsgegevens voor administratieve doeleinden zoals beheer van bestellingen, facturen, leveringen en opvolging van de solvabiliteit.

Persoonsgegevens worden niet doorgegeven aan derden. Voor meer informatie over privacy kan de klant terecht bij de Commissie voor de Bescherming van de Persoonlijke Levenssfeer in Brussel.

  • By submitting an order on the website of Sofie Nuyttens Jewellery, the buyer officially consents to the processing of his or her personal data for administrative purposes, such as management of the customer files, orders, invoices and deliveries and the follow-up of financial solvency.

Sofie Nuyttens Jewellery will not pass on personal data to third parties.

If the buyer-consumer wishes more information about privacy regulations in general, he can contact the Commission for the Protection of Privacy in Brussels.

 

13. AANSPRAKELIJKHEID WEBSITE - LIABILITY FOR USE OF WEBSITE

  • De website van Sofie Nuyttens Jewellery is bedoeld om klanten te informeren over de producten.

De website kan op elk moment tijdelijk onderbroken worden voor onderhoud, updates of andere redenen zonder voorafgaande melding.

De verkoper kan niet aansprakelijk gesteld worden voor schade veroorzaakt door internetstoringen, virussen, tussenkomst van derden of andere overmachtssituaties.

  • The website of Sofie Nuyttens Jewellery is intended to provide the customer with information about the products sold on the website.

Sofie Nuyttens Jewellery has the right to suspend or discontinue the site in whole or in part at any time for maintenance, updating or any other reason, without prior warning.

The seller cannot be held accountable for any damage caused by the use of the Internet, by any breakdown of the system, the intrusion of outsiders or a virus, nor for any information placed or processed on it by third parties. This that can be regarded as force majeure event.

 

14. TOEPASSELIJK RECHT - APPLICABLE LAW

  • Alle overeenkomsten met Sofie Nuyttens Jewellery vallen onder het Belgische recht. Geschillen worden exclusief behandeld door de bevoegde rechtbank in België.
  • All agreements made with Sofie Nuyttens Jewellery are subject to the Belgian law. All disputes between parties will be submitted exclusively to the authorized judge in Belgium.

 

15. INTELLECTUELE EIGENDOM - INTELLECTUAL PROPERTY

  • Alle producten en content op de website, facebook en Instagram van Sofie Nuyttens Jewellery zijn exclusieve eigendom van Sofie Nuyttens Jewellery en beschermd door auteursrecht.
  • All products on the Sofie Nuyttens Jewellery site, including the products on the linked instagram account, are the exclusive property of Sofie Nuyttens Jewellery and protected by copyright.

Users who have their own website and who, want to set up an automatic link between their own site and the seller's home page, must explicitly request permission from Sofie Nuyttens Jewellery.
